1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Teymensel ("we", "us", or "our"), concerning your access to and use of the Teymensel Mind mobile application (com.teymensel.mind), website at https://mind.teymensel.com, and related sync and AI services (the "Services").

By accessing or using our Services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the Services.

2. Eligibility & Account Security

You must be at least 13 years old (or 16 in the European Union) to use the Services. If you access the Services via Google Sign-In, you are responsible for maintaining the confidentiality of your Google account credentials and are responsible for all activities that occur under your account.

3. User Content & Intellectual Property Ownership

Your Content Belongs to You: You retain full copyright, ownership, and all intellectual property rights to any text, notes, checklists, code blocks, drawings, voice recordings, attachments, and ideas that you create, store, or submit to the Services ("User Content").

We do not claim any ownership over your User Content. You grant Teymensel solely a limited, non-exclusive, worldwide license to host, store, transmit, and display your User Content strictly as necessary to provide the Services (such as delivering real-time synchronization between your phone and computer, or running requested Mind AI summarizations).

4. Mind AI Capabilities & Disclaimer

Teymensel Mind provides optional artificial intelligence tools ("Mind AI") for note summarization, formatting assistance, and automated action item generation.

• Mind AI is an assistive productivity tool provided on an "as-is" basis.
• Generative AI may occasionally produce outputs that are incomplete or inaccurate. You are solely responsible for reviewing and verifying any information generated by AI before relying upon it.
• Teymensel shall not be liable for decisions made based on outputs generated by Mind AI.

5. Acceptable Use Policy

You agree not to use the Services to:

• Engage in illegal, fraudulent, harmful, or unauthorized activities.
• Interfere with, disrupt, or place an unreasonable load on our servers, WebSocket real-time relays, or connected networks.
• Attempt to reverse-engineer, decompile, or extract source code from the Services except as permitted by applicable law.
• Transmit viruses, malware, or destructive code.

6. Intellectual Property Rights of Teymensel

The Teymensel Mind application, branding, logo.png, graphics, user interface designs, custom painters, algorithms, and documentation are the exclusive property of Teymensel and are protected by copyright, trademark, and other intellectual property laws.

7. Termination & Account Deletion

You may stop using our Services at any time. You can delete your notes and clear your workspace records within the app or request full deletion of your cloud account by contacting [email protected]. We reserve the right to suspend or terminate accounts that materially violate these Terms.

8. Disclaimer of Warranties & Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEYMENSEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL TEYMENSEL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR SYSTEM DOWNTIME ARISING FROM YOUR USE OF THE SERVICES.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be instituted exclusively in the competent courts and execution offices of Sakarya, Turkey.
